Lateral Link is committed to safeguarding your privacy and “Personal Information,” which means information that may directly or indirectly identify you.  This Privacy Notice (“Notice”) is designed to assist you in understanding how we collect, use, disclose, share, and safeguard Personal Information, and to explain the choices and rights available to you. About Lateral Link

Lateral Link forms partnerships with legal industry organizations and companies in search of in-house counsel to optimize talent attraction and retention.  We work with clients to help them achieve their talent strategies and business goals, and we help potential candidates fulfil their career aspirations.

Our services include temporary staffing, temp-to-perm and direct placement/search of talent, including candidate recruitment, career counseling and guidance to candidates and job seekers as well as knowledge research by working with clients, candidates and job seekers to conduct research in the market regarding talent and workforce needs and dynamics. We perform legal recruitment for law firm placements, executive in-house legal placements, and both interim and permanent placements of specialty attorneys and counsel, and legal, paralegal, compliance, financial services personnel, as well as legal assistants, eDiscovery personnel, DEI officers, CISOs, chief operating officers, conflicts personnel, recruiting personnel, billing clerks, project managers, and research analysts, to assist with a variety of matters.

When this Notice Applies

This Notice applies to Personal Information we collect online and offline.  This includes information collected through our website(s) including laterallink.com and haistack.ai, email and related applications and content that link or refer to this Notice (collectively, the “Sites”); over the phone; and in person.  In some cases, we may provide additional data privacy notices specific to certain services, practices, or regions. Those terms are to be read in conjunction with this Notice. This Notice also applies when we are receiving services you are providing to us. This Notice does not apply to the practices of third parties that Lateral Link does not own or control.

Sources of Personal Information

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from You. For example, from the forms You complete on our Service, preferences You express or provide through our Service.
  • Indirectly from You. For example, from observing Your activity on our Service.
  • Automatically from You. For example, through cookies We or our Service Providers set on Your Device as You navigate through our Service.
  • From Service Providers. For example, third-party vendors to monitor and analyze the use of our Service, third-party vendors to provide advertising on our Service, or other third-party vendors that We use to provide the Service to You.
  • From publicly available information. We gather information from publicly available sources, for example individuals’ pages on public websites.

Additionally, we allow users of certain services, including haistack.ai, to create an account and log into that service through third-party credentials services, including Google, LinkedIn and Microsoft. If you decide to register through such third-party credentials systems, we may collect data associated with this your account with the third party, including your name, email address, activities, contact list, or other information associated with that account. If you do so, you grant the Company permission to use, share, and store such information in a manner consistent with this privacy notice.

Types of Personal Information We Collect

We collect or have in the preceding 12 months collected the following personal information, with CCPA categories noted in parentheses:

  • Identifying Information and Contact Information like your email address, telephone number, postal address and contact information of any referrals, references or emergency contacts you provide (§ 1798.140(v)(1)(A))
  • Online identifiers and device Information: including your IP address, unique device identifiers, diagnostic data, browser type and version, time zone setting, browser plug-in types and versions, location information on a city-regional basis, the pages of our websites you visit, the time spent on those pages, and your operating system and platform information when you are visiting our Site(s). When you access our Site(s) through a mobile device, we may additionally collect information automatically, including but not limited to the type of your mobile device and your mobile device unique ID (§ 1798.140(v)(1)(A))
  • Characteristics of Protected Classifications under California or Federal Law: including your race, gender, national origin, disability status and veteran status, where we are required to or permitted to do so by law and in support of equal opportunity monitoring or affirmative action programs. (§ 1798.140(v)(1)(C))
  • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement (§ 1798.140(v)(1)(F))
  • Audio, Visual or Similar Information: including photos that you provide to us or that you make publicly available on the internet (for example LinkedIn or company/firm websites); and your image from a security camera if you visit one of our locations (§ 1798.140(v)(1)(H))
  • Educational and Professional Background Information: including your resume or C.V., employment history, education history, certifications, professional license information (for example bar registration number), languages proficiencies, security clearance information, professional association memberships, volunteer activities, client information where relevant (for example we may collect information from attorneys we place through our staffing and search business regarding clients the attorney has performed services for) and work-related skills, practice details and skills assessment information including personality characteristics / traits which you choose to provide on a voluntary basis (§ 1798.140(v)(1)(I)-(J))
  • Career Planning Information: including your career interests, desired compensation and benefits, desired work location and willingness to relocate, family information as it relates to your career goals or plans, and hobbies and interests (§ 1798.140(v)(1)(I))
  • Inferences drawn from any of the information identified in this subdivision to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes (§ 1798.140(v)(1)(K))
  • Other Information: including any other Personal Information you may elect to provide to us or that we obtain in the course of our recruiting and staffing services.

Who we Collect Personal Information From

We collect personal information from the following categories of individuals;

  • Visitors who are visiting or using our Site(s) or office locations or any of our Services, so that we can provide you with the Site(s) or Services you require;
  • Recruitment and employment candidates and job seekers: We collect information about individuals who are potentially suited for recruitment and/or employment in the legal industry, in order to provide recruiting and related services.  This includes information from publicly available sources, information supplied to us, and information obtained from third-party vendors about potential candidates. if you apply for or we contact you about job opportunities with Lateral Link to fill our internal positions or positions through our staffing and recruiting services or search, workforce management, or talent advisory services (once you have been identified for a specific position with us to fill our internal roles or to fill staffing positions with our clients you should view our notices and policies for job applicants and employees mentioned in the Introduction section above);
  • Customers, vendors, service providers, and other suppliers; and
  • Referees and others who advise on the suitability of job seekers.

Note that if you submit any Personal Information relating to other people to us or to our service providers in connection with our Services, you confirm that you have the authority to do so and to permit us to use the information in accordance with this Notice.

Sensitive Personal Information

We generally do not collect information from you that would be considered “sensitive personal information” under applicable authorities. However, we may collect information about your ethnicity or union membership as relevant to the legal recruiting or staffing process and diversity and inclusion measures.  In some cases, we may collect government-issued identification numbers (such as driver’s license numbers) where necessary for our services or required by law.  We do not sell or disclose such sensitive personal information.

The Purpose Of Collecting Personal Information

We collect and use your personal information for our business and commercial purposes, including:

  • Contacting You for the purposes listed below.  We may contact you by telephone, email, text messaging, or otherwise.
  • Recruiting and Hiring for current and future job opportunities with us or with our customers, including determining your eligibility and suitability for such opportunities. This may include for example sending Educational and Professional Background Information, such as your CV, to prospective employers for their consideration and keeping you informed of future work opportunities by email, telephone, mail, text message, and/or other communication methods (note that messaging and data rates may apply for any SMS, MMS, and other electronic communications (typically, this is based on your carrier and service plan)).
  • Providing our Services, including our core recruiting and staffing services as well as our various other services such as consulting and advisory services.
  • Machine Learning and Artificial Intelligence, including our efforts to discern patterns predicting successful placements of recruiting candidates.
  • Receiving Services, including receiving services from various vendors, suppliers, service providers and contractors.
  • Operating and Improving our Site(s), for example we use your device and information you provide to establish and maintain an account for you on our Site(s) and to improve the navigation and usage of our Site(s).
  • Business Sales Development, for example using your contact information to call or email you as a talent candidate, customer or prospect as part of providing our Services.
  • Marketing and Promotions, including sending you promotional communications such as newsletters, surveys, articles of interest, press releases and job fair or other event announcements and personalizing and delivering content about our Services to you, including through advertisements on our Site(s) and other websites.
  • Improving Our Services through business analytics, internal audits, troubleshooting, quality control, internal user acceptance testing and use of machine learning to improve our search and match capabilities in matching job seekers to suitable jobs efficiently and effectively.
  • Research and Thought Leadership, including articles regarding customers and candidates, and white papers, podcasts and other thought leadership regarding workforce, talent and industry trends and analysis.
  • Meeting Substantial Public Interest, such as equal opportunity monitoring and programs that promote diversity and inclusion.
  • Aggregation and Anonymization, including the process of using Personal Information to create aggregated or anonymized data sets for the purpose of internal business analysis or thought leadership with the end product of such data sets not being Personal Information since it is not identifiable to an individual.
  • Security and Fraud Prevention to ensure the security of our Site(s) and Services, to protect against fraud, and to comply with legal requirements.
  • Compliance with Laws, Legal Action and Professional Advice, including compliance with all laws and regulations and addressing legal action or taking professional advice, for example from attorneys or tax professionals.

Personal Information We Sell Or Share 

Lateral Link may disclose certain categories of Personal Information about you for the business purposes mentioned in this Notice to the following categories of third parties, which will process such Personal Information in accordance with their own policies and procedures (references to CCPA categories of information are in parentheses):

  • Potential Employers or Potential Customers – We may disclose your contact information, professional and work eligibility information, career planning information, demographic information, and other information you ask us to disclose to a customer for the purpose of providing our Services for opportunities we believe are of interest to you. We may also disclose information about recruiting and staffing candidates to prospective employers, including their identifying information, professional, employment and education information, and inferences drawn from other categories of information, in order to facilitate recruitment for employment (§ 1798.140(v)(1)(A), (I)-(K))
  • Vendors, Contractors, and other Service Providers – We use vendors, contractors, and other service providers to assist us in providing our Services, and it may be necessary for us to provide access to some of the categories of your Personal Information (for example, IT operating system and platform vendors who support our systems, SaaS vendors such as applicant tracking systems, customer relationship management systems and back office systems, assessment services, marketing services vendors, attorneys and accountants as well as premises and other security management vendors, including video security at our office locations). These companies will have access to your Personal Information as necessary to perform their functions, but they may only use that information for the purpose of providing the services and are obligated to protect the Personal Information. (§ 1798.140(v)(1)(A), (F), (H), (I)-(J))
  • Lateral Link affiliates – We may disclose your Personal Information to Lateral Link affiliates, which are companies that have ownership in Lateral Link, are owned by Lateral Link, are under common control with Lateral Link, or share common branding with Lateral Link. We may share this information, for example, to match you to job opportunities, to assist employers in identifying you as a candidate for employment, and/or to utilize shared service functions within Lateral Link.   • Business Transfer Partners – Circumstances may arise where, whether for strategic or other business reasons, Lateral Link decides to sell, buy, merge, or otherwise reorganize businesses. Such a transaction may involve, in accordance with applicable law, the disclosure of Personal Information to prospective or actual purchasers, or the receipt of it from sellers. It is Lateral Link’s practice to seek and provide appropriate protection for Personal Information in these types of transactions. (§ 1798.140(v)(1)(A), (F), (H), (I)-(K))
  • Courts, Regulators, Law Enforcement and Government Authorities – We may disclose your Personal Information where we are legally required to do so in order to respond to or comply with any applicable law, regulation, subpoenas, court orders, legal process, or government requests, including in response to public authorities to meet national security or law enforcement requirements. We also may disclose your Personal Information when we choose to establish or exercise our legal rights or defend against legal claims or to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or violations of Lateral Link’s terms of use, its policies or this Notice. Please note that if you post any Personal Information in a public area of our Site(s), the information that you share will be visible to others and can be read, used, or collected by others. Lateral Link is not responsible for the way others may use Personal Information you post to public areas of the Site(s).

Your Privacy Rights 

We respect your privacy rights related to the Personal Information we collect, use and disclose about you and we will comply with applicable data protection laws and regulations in the handling of your Personal Information. The availability of these rights and the ways in which you can exercise them are set out below.

If we deny your privacy rights request, we will explain why.

Specific California Privacy Rights

For California residents, you are given rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act of 2020 (“CCPA”) to request that Lateral Link disclose the following about the Personal Information we collect, use and disclose about you:

  • The right to know what Personal Information we collected about you, including the:
    • the categories of Personal Information;
    • the categories of sources where we obtained Personal Information about you;
    • the business or commercial purpose for collecting, selling or sharing Personal Information (if applicable);
    • the categories of third parties to whom we disclose Personal Information; and
    • the specific pieces of Personal Information we collected about you.
  • The right to know what Personal Information we sold or shared about you, including
    • the categories of personal information that the business collected about the consumer.
    • the categories of personal information that the business sold or shared about the consumer and the categories of third parties to whom the personal information was sold or shared, by category or categories of personal information for each category of third parties to whom the personal information was sold or shared.
    • the categories of personal information that the business disclosed about the consumer for a business purpose and the categories of persons to whom it was disclosed for a business purpose.
  • The right to delete Personal Information we collected from you, subject to certain exceptions (for example, we may refuse your deletion request if we are permitted by law to keep the information);
  • The right to correct inaccurate Personal Information that we maintain about you;
  • The right to opt out of the sale or sharing of Personal Information; and
  • If we use or disclose Sensitive Personal Information for purposes other than those allowed by the CCPA, the right to limit our use or disclosure.

Additionally, you have the right to be free of discrimination for exercising your consumer privacy rights.

We do not knowingly collect or sell the Personal Information of minors under 16 years of age, do not offer any financial incentives in exchange for your Personal Information, and do not collect Sensitive Personal Information from you except as otherwise identified in this Notice.

Specific Utah Privacy Rights

This section applies only to Utah residents. Under the Utah Consumer Privacy Act (UCPA), as of December 31, 2023, you will have the rights listed below. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.

  • Right to be informed whether or not we are processing your personal data
  • Right to access your personal data
  • Right to request deletion of your personal data
  • Right to obtain a copy of the personal data you previously shared with us
  • Right to opt out of the processing of your personal data if it is used for targeted advertising or the sale of personal data

Specific European Rights, Including GDPR Privacy

Lateral Link reserves the right to argue that it does not meet the requirements to trigger European data privacy laws, including the GDPR. Nevertheless, Lateral Link strives to protect individuals’ personal information regardless of geographic location. For relevant purposes, Lateral Link is the data controller.

Legal Bases for Processing Data

We rely on multiple legal bases to process data. If you are in the European Economic Area (“EEA”), United Kingdom or Switzerland, our legal basis for processing Personal Information about you will depend on the type of Personal Information and the purpose for which we collect it. Processing of your Personal Information is permitted under applicable law and legal bases because, including:

  • Consent: We may rely on consent to collect and process Personal Data as it relates to how we communicate with you and for the provision of our Services.  When we process data based on your consent, you have the right to withdraw your consent at any time without affecting the lawfulness of processing based on such consent before the consent is withdrawn.
  • Contract: We need to process the Personal Information to perform a contract with you or to take steps at your request prior to entering into a contract or potential contract;
  • Legal Compliance: We need to process the Personal Information for compliance with a legal obligation to which the Company is subject.
  • Vital, public, or legitimate interests: Processing Personal Data is necessary in order to protect Your vital interests or of another natural person, related to a task that is carried out in the public interest or in the exercise of official authority vested in the Company, and/or necessary for the purposes of the legitimate interests pursued by the Company.

If you are within the European Economic Area, the United Kingdom, or Switzerland, you have the following rights:

  • Right to access: You have the right to request information about the Personal Information we hold about you and to obtain a copy of that Personal Information.
  • Right to rectification: You have the right to request the correction of inaccurate Personal Information or to complete incomplete Personal Information.
  • Right to erasure: You have the right to request the erasure of your Personal Information in certain circumstances.
  • Right to restrict processing: You have the right to request that we restrict the processing of your Personal Information in certain circumstances.
  • Right to data portability: You have the right to receive your Personal Information in a structured, commonly used, and machine-readable format and to transmit that data to another controller.
  • Right to object: You have the right to object to the processing of your Personal Information in certain circumstances, including processing for direct marketing purposes.
  • Right not to be subject to automated decision-making: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

How to Exercise Your Privacy Rights

If you would like to exercise any of your privacy rights, please complete the web form here, (866) 374-5829, or email privacy@laterallink.com to submit your request.  If you are submitting a request on behalf of a California resident, please submit the request through one of the designated methods discussed above.  For all requests, after submitting the request, we will require additional information to reasonably verify your identity depending on the nature of your request, including for those acting as a representative for a California resident your authority to act on behalf of the California resident.

We endeavor to by all applicable legal requirements for deadlines for responding to your request and will collect the minimum Personal Information necessary to verify your identity. If you experience any issues with our web form or phone number, please contact privacy@laterallink.com.  Only you or a sufficiently qualified agent to act on your behalf may make a verifiable request related to your personal information.  To be a verifiable request, your request must provide sufficient information that allows us to reasonably verify are the person about whom we collected personal information or an authorized representative; and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with the required information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you

We will disclose and deliver the required information free of charge within 45 days of receiving your verifiable request. The time period to provide the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice.  Any disclosures we provide will only cover the 12-month period preceding the verifiable request’s receipt. For data portability requests, We will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

Your Right to Opt-Out from Marketing Communications

Where it is in accordance with your marketing preferences and applicable data protection laws, we may periodically send you updates via e-mail about promotional opportunities or services we think may interest you, such as jobs in our database that match your selection criteria, newsletters, white papers, surveys and event information.

You can opt-out of receiving marketing emails from us by clicking the unsubscribe link contained in such emails.  If you continue to have issues in unsubscribing from marketing emails from us, you may submit the form mentioned above or call the toll-free number and request to opt-out.

Cookies and Online Tracking

We may use cookies, tracking pixels, web beacons and similar technologies (collectively “cookies”) to help personalize your online experience, to collect and track information, to improve and analyze our services, and for analytics purposes. The following identifies the categories of Personal Information that we disclosed for a business purpose in the 12 months preceding the Effective Date of this Notice and, for each category, categories of recipients to whom we disclosed Personal Information.  For all of the Personal Information categories below, we may disclose, as appropriate under the circumstances, to government or law enforcement entities and lawyers.

We disclosed Personal Information to the above categories of recipients for all of the business or commercial purposes identified in the above “Why Do We Collect Your Personal Information” section.

Sale and Sharing of Personal Information

This section will explain to you the instances in which we sell or share your Personal Information, as each is defined by the CCPA.  We may sell and share your personal information as noted in the section above entitled “Who we Disclose and Sell Personal Information To.”  We do not knowingly sell or share your Personal Information for cross-context behavioral advertising, which includes our use of third-party analytics services and online advertising services.   These are described in detail in our Cookie Notice and may result in the disclosure of your online identifiers (e.g., cookie data, IP address, device identifier and usage information).

You have the right to opt out of the sale or sharing of your Personal Information by managing your cookie settings and opting out of all targeted advertising cookies or by enabling Global Privacy Control settings within your browser.  To opt out of the sale or sharing of your personal information, click the Cookie Settings link at the bottom of this page.

Other CCPA Rights

We do not offer any financial incentives in exchange for your Personal Information. Please see Your Privacy Rights section of this Notice for the rights you have as a California Resident and how to exercise them. Please see information under Data Retention section of our Privacy Notice for information regarding how long we retain your Personal Information.

California “Shine the Light” Disclosure

The California “Shine the Light” law gives residents of California the right under certain circumstances to opt out of the disclosure of certain categories of Personal Information (as defined in the Shine the Light law) with third parties for their direct marketing purposes, or in the alternative, that we provide a cost-free means for consumers to opt out of any such disclosure.  We do not currently disclosure your Personal Information to third parties for their own direct marketing purposes.

Facebook Fan Page

The Company is the Data Controller of Your Personal Data collected while using the Service. As operator of the Facebook Fan Page https://www.facebook.com/LateralLinkGroup, the Company and the operator of the social network Facebook are Joint Controllers.

The Company has entered into agreements with Facebook that define the terms for use of the Facebook Fan Page, among other things. These terms are mostly based on the Facebook Terms of Service: https://www.facebook.com/terms.php

Security of Your Personal Information

Lateral Link is committed to protecting the Personal Information you share with us. Lateral Link uses appropriate physical, technical, organizational and administrative security measures to help protect your Personal Information from unauthorized or unlawful access, use, or disclosure, and from accidental loss, destruction, or damage.

Data Retention

We retain Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy. Additionally, we will retain and use such information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. And we will retain such data we collect from you where we have an ongoing business need to do so (for example, to provide you with the Service you have requested to maintain you in our talent pool to be potentially contacted about other employment opportunities or to comply with applicable legal, tax or accounting requirements). The Company will also retain data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit) for internal analysis purposes. This daa is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our services or we are legally obligated to retain this data for longer time periods.

Analytics

We may use third-party Service providers to monitor and analyze the use of our Service, including:

  • Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

  2. Identify connections between candidates and existing firm attorneys
  3. Discern patterns in predicting successful candidate placements

  5. Analyze attorney retention risks and market demand
  6. Provide tailored market insights for law firms

If you live in certain jurisdictions, you may have the right to object to any wholly automated processing of your details: that is processing of your personal data done entirely by a computer without any human intervention.
